We believe in transparency about how we collect and use data. This Cookie Policy explains what cookies and similar technologies we use, why we use them, and how you can control them.

What is a cookie?

Cookies are small text files placed on your device by a website. They are unique to your account or your browser. Session-based cookies last only while your browser is open and are automatically deleted when you close your browser. Persistent cookies last until you or your browser delete them or until they expire.

We also use similar technologies such as pixels and tags.

Different types of cookies include:

Session vs. persistent cookies: cookies have a limited lifespan. Cookies which only last a short time or end when you close your browser are called session cookies. Cookies which remain on your device for longer are called persistent cookies (these are the type of cookies allow websites to remember your details when you log back onto them).

First party vs third party cookies: cookies placed on your device by the website owner are called first party cookies. When the website owner uses other businesses’ technology to help them manage and monitor their website, the cookies added by the other business are called third party cookies.

Categories of cookies: cookies can be grouped by what they help the website or website owner do.

  • Necessary cookies are cookies which help the website to run properly (when they are strictly necessary cookies it means their only function is to help the website work).
  • Preference cookies (sometimes called functionality cookies) allow Brainfish to remember your preferences such as language settings, region, or account-specific choices and perform certain functionalities like sharing the content of the website on social media platforms, collecting feedback, and other third-party features.
  • Statistics cookies (sometimes called analytics or performance cookies) help us understand and analyze how visitors use the website, for example by collecting information on visitor numbers, bounce rates, and popular pages.
  • Marketing cookies (sometimes called advertising cookies) are used to track visitors across websites And to provide visitors with customized advertisements based on the pages you visited previously and to analyze the effectiveness of the ad campaigns.

For users in the UK and EU, non-essential cookies (statistics, marketing, preference) will only be placed with your prior consent, in line with the EU and UK GDPR, EU  ePrivacy Directive and UK Privacy and Electronic Communications Regulations 2003 (PECR), which mandate that consent must be obtained before setting non-essential cookies.

Consent must be freely given, specific, informed and unambiguous. You can withdraw your consent at any time via our cookie settings link.

Does Brainfish use cookies?

Yes. Brainfish uses cookies and similar technologies like single-pixel GIFs and web beacons. We use both session-based and persistent cookies. Brainfish sets and accesses our own cookies on the domains operated by Brainfish and its corporate affiliates (collectively, the “Site”). In addition, in some instances, we use third-party cookies, such as Google Analytics.

Some of these third parties act as independent controllers of the personal data they collect via cookies (e.g. advertising platforms). Their use of personal data is governed by their own privacy policies, which we encourage you to review.

How does Brainfish use cookies?

Some cookies are associated with your account and personal information in order to remember that you are logged in and which accounts you are logged into. Other cookies are not tied to your account but are unique and allow us to carry out analytics and customization, among other similar things.

Cookies can be used to recognize you when you visit a Site or use our services, remember your preferences, and give you a personalized experience consistent with your settings. Cookies also make your interactions faster and more secure.

  • Authentication cookies allow us to show you the correct information, personalize your experience and verify your access to your account
  • Some cookies enable and support security features to help us detect malicious activity on our website
  • Some cookies allow us to retain your choice of language in certain areas, and may provide features, insights or other customizations

We may also use cookies to help us deliver marketing campaigns and track their performance (e.g., a user visited our Help Center and then made a purchase). Similarly, our partners may use cookies to provide us with information about your interactions with their services, but use of those third-party cookies would be subject to the service provider’s policies.

We may also use advertising and targeting cookies provided by LinkedIn, Google Ads and other platforms, which help us reach potential users and measure the effectiveness of campaigns.

Performance, Analytics and Research Cookies help us learn how well our Sites and services perform. How are cookies used for advertising purposes?

Cookies and other advertising technology such as beacons, pixels, and tags help us market more effectively to users that we and our partners believe may be interested in Brainfish. They also help provide us with aggregated auditing, research, and reporting, and know when content has been shown to you.

In some jurisdictions (such as California), these cookies may be treated as a “sale” or “sharing” of personal data. You have the right to opt-out, see below.

For users in the UK and EU, advertising cookies will only be deployed where you have actively consented through our cookie banner or settings.

What can you do if you don’t want cookies to be set?

For non-essential cookies, our lawful basis under the UK GDPR and EU GDPR is your consent. You can withdraw that consent at any time.

We can only use cookies with your permission (you will be prompted by a message when you first visit our Website, also known as a cookie banner, where you can choose to accept or decline our cookies).  You can update your settings on our Website at any time.

Most browsers give you the ability to manage cookies to suit you. In some browsers you can set up rules to manage cookies on a site-by-site basis, giving you more fine-grained control over your privacy. What this means is that you can disallow cookies from all sites except those that you trust.

Browser manufacturers provide help pages relating to cookie management in their products. Please consult the documentation that your browser manufacturer provides for details on this.

You may opt-out of third-party cookies directly with the relevant third party, for example, you can disable Google Analytics on their website.

You can opt out of interest-based targeting provided by participating ad servers through the Digital Advertising Alliance (https://youradchoices.com). In addition, on your iPhone, iPad or Android, you can change your device settings to control whether you see online interest-based ads.

If you limit the ability of websites and applications to set cookies, you may worsen your overall user experience and/or lose the ability to access our services, since it will no longer be personalized to you. It may also stop you from saving customized settings, like login information.

You can also opt out of Brainfish’s use of non-essential cookies at any time by adjusting your cookie settings link or by withdrawing consent through your browser settings. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

If you are located in the UK or EU and are not satisfied with how we use cookies or handle your personal data, you have the right to lodge a complaint with your local Data Protection Authority. In the UK this is the Information Commissioner’s Office (ICO), and in the EU you can contact your national supervisory authority.

US residents: If you are based in California, Virginia, Colorado, or other US states with privacy laws, you may have the right to opt out of certain cookies under those laws. Please visit our Do Not Sell/Share My Personal Information link.
